Civil Litigation

Civil litigation is the term used when individuals or corporations are unable to resolve their disputes and institute legal proceedings in Court.

“Civil” infers that the dispute is between private citizens (or companies). The word “litigation” is the term used to describe Court proceedings.

Notices of Demand: As a general rule, before proceedings can be issued in Court, the first step is to issue a formal Notice of Demand. The Court requires parties to give each other fair warning that legal proceedings may be issued.

Injunctions: In extremely urgent circumstances, it is possible to apply to the Court for an injunction to be issued to restrain or stop another party, or sometimes make another party, do something urgently if the circumstances require that immediate and urgent action be taken, failing which one party might suffer extreme prejudice.
